§ 3.34.010. Inmate processing fee.

  • A need exists to establish a chargeable fee by the Porter County Sheriff's Department for the processing of inmates in and out of the Porter County Jail.

    The seventy-five dollar ($75.00) inmate processing fee shall apply only to convicted defendants. The fee will be assessed at sentencing by a Porter County judge, or in the alternative, in the case of pre-trial deferral, only if the defendant has agreed to pay the fee as part of his pre-trial diversion agreement. The seventy-five dollar ($75.00) inmate processing fee shall be taken first from the bond, and it not available, shall be assessed at sentencing for payment to the county clerk.

    The inmate processing fee shall not apply and/or may be waived by the Porter County Sheriff and/or a Porter County Judge in the below identified instances:

    (a)

    Where the inmate is indigent;

    (b)

    Where the inmate is being held for another agency for a per diem payment;

    (c)

    Where the inmate is being held for safekeeping for another agency.
